That's the flaw in your argument. Please continue to use
  <IMG border=0>
if you care about NN4 (you should for commercial sites), but what's
the problem with HTML 4.01 Transitional or XHTML 1.0 Transitional? The
Advanced DOM scripting will not care about this Doctype you put on
top (and I wonder what advanced DOM scripting you try to pull of in
Netscape 4.x anyway :) )

You could just as well leave the Doctype of all together, or roll your
own DTD (I did) to make validation a more useful tool. IMO, validation
is a tool, not a goal.
