I have done a kick out menu like this, looks different but basically the same function. It works on everything I have tested, and it kicks out to 3 levels. The menu is CSS with a little javascript. If you look at the style sheet the bottom half is commented to show where the nav menu starts. I got a lot of the code from links on the WIKI and some help from this list and webdesign-l.
