In this scenario:

Any one of the columns height can end up being the tallest on the page
so given the above scenario the footer clears the 3 columns because the
static box is the longest. But, if the middle or right column becomes
longer then the left column then the content of the middle column
overlaps the footer. I also tried using floats and clearing them but
this introduces all sorts of cross compatibility problems and for the
most part was not working either.
